General terms of use
Purpose and scope
These terms govern the use of the Dronops platform (app.dronops.io), a SaaS management and compliance service for operators of uncrewed aircraft, published by DRONOPS SAS (SIREN 102 986 635, RCS Bordeaux), whose registered office is at 119 Boulevard du Président Wilson, 33000 Bordeaux, France. They bring together the terms of use (articles 1 to 9), the general terms of sale (articles 10 to 15) and the annexed data processing agreement (articles A1 to A10), which form a single whole. The platform is reserved for professionals acting for the purposes of their business: operators, remote pilots and the organisations that employ them. It is not offered to consumers within the meaning of the French Consumer Code.
Account, access and roles
Creating an account requires a valid email address. The user is responsible for keeping their credentials confidential. A customer account is opened in the name of an operator, whether a legal entity or a sole trader. Its administrator invites the members of their team and gives each a role — administrator, operations lead, internal or external remote pilot, observer, read only — which determines what they can see and do; the customer answers for the access it grants and for the use made of it. One person may be a member of several operators, with a distinct role at each.
Plans and billing
The plans and prices in force are described on the pricing page. Monthly or annual billing. Full refund of the annual subscription if you request it within 14 days of its first payment, renewals excluded; your account then returns to the Free plan. This refund is a commercial gesture by DRONOPS: no withdrawal period applies between professionals. The Pro plan includes 1 remote pilot, then €10 excl. VAT/month per additional remote pilot, or €8 excl. VAT/month on annual billing, up to 10 remote pilots; beyond that, the Enterprise offer is quoted on request. Payments are collected by Stripe, our payment provider. Payment, late payment and price revisions are governed by articles 10 to 12.
Confirmed early-access sign-ups who open an account get 50% off the first year of the annual subscription; every annual renewal then gets 25% off, for as long as the subscription stays annual.
Termination
Termination at any time, effective at the end of the paid period. After termination, your account remains accessible for 30 days: you can go on retrieving your files from it. Once that period has passed, the account is closed, personal data is replaced by a marker, and the records the regulations require the operator to keep are retained on its behalf and on its instructions (article A9), without a name, except the signed documents handed to the authorities (MANEX, CERFA, request sent to the town hall), which keep the names they carry.
Liability — regulatory compliance
Essential clause: Dronops is a management and compliance support tool. It replaces neither official texts, nor authority decisions (DGAC, DSAC, prefectures), nor the operator's responsibility. The operator remains solely responsible for the compliance of their operations, the accuracy of the data entered and the filings submitted. The limits of DRONOPS's liability are set out in article 13.
Customer data
The data entered remains the property of the operator. Dronops hosts it in France, at OVH, and does not exploit it for third-party commercial purposes. For the personal data the operator has processed on the platform (the membership, role and file of the members of its team, remote pilots, missions, flights, declarations, MANEX), the operator is the controller and DRONOPS acts as processor within the meaning of Article 28 of the GDPR, under the data processing agreement annexed to these terms. Each user's sign-in account, on the other hand, falls to DRONOPS as the controller of that processing, as the privacy policy describes. Its processing involves sub-processors, third-party services called by your browser, and the authorities you file declarations with: the privacy policy gives the full list, with the purpose of each, its location and, outside the European Union, what governs the transfer.
Support
Support: Online guides + problem report on every plan; Email on the Pro plan.
Governing law and disputes
These terms are governed by French law. Any dispute relating to their formation, performance or interpretation that could not be settled amicably falls within the exclusive jurisdiction of the courts of Bordeaux, including where there are several defendants or a third-party claim.
Cookies and trackers
Without your agreement the public site sets only the cookies strictly necessary for it to work. The others are grouped into categories, which you set separately:
- Strictly necessary — session, form protection, remembering your decision. Always on, they cannot be refused.
- Audience measurement — counting visits and pages read. No tool is in service today; should one ever be, it will be named in the privacy policy and will run only with your agreement.
- The link that brought you — remembering the code of the partner link you arrived through. Off until you turn it on.
- Support chat — a chat window opened from the site. Not switched on today; should it ever be, it will load only with your agreement.
The name, purpose and duration of each cookie are listed in the preferences panel, which you can reopen at any time from the footer to change or withdraw your agreement.
General terms of sale — business customers
Order and payment
Subscribing to a paid plan constitutes an order at the price shown on the pricing page on the day of subscription. Subscriptions are payable in advance, at each monthly or annual due date, by the payment methods Stripe offers when you subscribe. An invoice is issued at each due date and remains downloadable from the application's Billing page.
Late payment and payment default
Any sum unpaid at its due date bears, automatically and without any prior formality, late-payment penalties at three times the French statutory interest rate, plus a flat-rate indemnity for recovery costs of €40 (articles L441-10 and D441-5 of the French Commercial Code); where the costs incurred are higher, an additional indemnity may be claimed on proof. When the payment of an instalment fails, it is automatically presented again for [period of payment retries]; the customer keeps access to the paid features during that time. If the payment has not succeeded by the end of these retries, the subscription ends: the account returns to the Free plan and the customer's data is kept. A later payment does not restore the subscription: returning to the paid features requires taking out a new subscription.
Price revisions
DRONOPS may change its prices. Any increase is announced to the customer by email at least [price revision notice period] before it applies, which happens at the next due date; a customer who refuses it may terminate the subscription before that date, at no cost.
Limitation of liability
DRONOPS is bound by an obligation of means. Its liability, on all grounds combined, is limited to proven direct damage and capped at [liability cap]. DRONOPS is not liable for indirect damage, such as loss of business or revenue, nor for administrative penalties incurred by the operator, who remains solely responsible for its operations (article 5). These limitations do not apply in the event of gross negligence or wilful misconduct by DRONOPS. Neither party is liable for a failure caused by force majeure within the meaning of article 1218 of the French Civil Code. DRONOPS uses reasonable means to keep the service available, without committing to an availability rate.
Right to use the platform
For the duration of its subscription, DRONOPS grants the customer a personal, non-exclusive and non-transferable right to use the platform for the needs of its own business, within the limits of its plan. The platform, its software and its content remain the property of DRONOPS: the customer shall not copy, resell or decompile them, nor extract their content by means other than the platform's own features. The data entered by the customer remains its property (article 6).
Changes to these terms
DRONOPS may change these terms. Any change is announced to the customer by email at least [notice period for changes to these terms] before it takes effect; a customer who refuses it may terminate at no cost before that date. The applicable version is dated at the foot of this page.
Annex — Data processing agreement (Article 28 GDPR)
This agreement supplements the general terms for the personal data the customer has processed on the platform. It prevails over them in case of contradiction.
Subject matter and duration
This agreement applies to the personal data that the customer, an operator of uncrewed aircraft, records or has recorded on the platform. For this data, the customer is the controller and DRONOPS acts as processor within the meaning of Article 28 of the GDPR. The agreement applies for the whole duration of the subscription, then until the data is returned and deleted as provided in article A9.
Nature and purpose of the processing
DRONOPS hosts, records, organises, formats, prints and transmits this data for the sole purpose of providing the platform: preparing and following missions, keeping the remote pilots' files and the records article UAS.SPEC.050 of Regulation (EU) 2019/947 requires of the operator, producing the MANEX, the CERFA forms and the authorisation requests, and sending them to the authorities and bodies the customer designates.
Data subjects and categories of data
Data subjects: the members of the customer's team, for their membership of the team, their role and their file — their sign-in account falls to DRONOPS as the controller of that processing —, its internal and external remote pilots, the officers and representatives named on its Kbis extract, and its emergency contacts. Categories of data: identity and contact details; remote pilots' date and place of birth and postal address; licences, certificates and qualifications with their scans; flights and missions; documents sent to the authorities; the account's activity journal. No special category of data within the meaning of Article 9 of the GDPR is required.
The customer's instructions
DRONOPS processes this data only on the customer's documented instructions, which consist of these terms and of the customer's use of the platform's features, including with regard to a transfer to a third country, unless required to do so by Union or French law; in that case, DRONOPS informs the customer of that legal requirement before processing, unless that law prohibits such information on important grounds of public interest. If an instruction appears to it to infringe data protection law, DRONOPS informs the customer immediately.
Confidentiality and security
The persons authorised to process this data at DRONOPS are bound by confidentiality. DRONOPS implements the security measures of Article 32 of the GDPR, including hosting in France, encrypted exchanges, hashed passwords, access rights granted by role, and logging of access and changes, including during takeovers by support.
Sub-processors
The customer authorises DRONOPS to engage the sub-processors named in the privacy policy, notably OVH for hosting and Brevo for sending emails, bound to DRONOPS by a contract imposing on them the same data protection obligations. Any transfer of this data outside the European Union by a sub-processor is governed in accordance with Chapter V of the GDPR; the privacy policy states, for each, what governs the transfer. DRONOPS informs the customer by email, in advance, of any addition or replacement; the customer may object on legitimate grounds before it takes effect and, failing agreement, terminate its subscription at no cost.
Assistance to the customer
DRONOPS assists the customer, through appropriate technical and organisational measures, in responding to requests from data subjects exercising their rights; a request received directly by DRONOPS is forwarded to the customer without delay. DRONOPS also assists it, taking into account the information available to it, in meeting its obligations regarding security, personal data breach notification, data protection impact assessment and prior consultation of the CNIL.
Personal data breach
DRONOPS notifies the customer of any personal data breach without undue delay after becoming aware of it, with the information available to it, so that the customer can meet its own notification obligations.
Data at the end of the contract
At the end of the subscription, the customer retrieves its data during the 30 days its account remains accessible (article 4). DRONOPS then deletes the personal data or makes it anonymous. The records the regulations require the operator to keep, notably under article UAS.SPEC.050 of Regulation (EU) 2019/947, including the signed documents submitted to the authorities, are kept on the customer's behalf and on its instructions, which this agreement constitutes, for at least the period those regulations impose on it, under the conditions of article 4.
Audits
DRONOPS makes available to the customer the information necessary to demonstrate compliance with this agreement and allows for audits, including inspections, by the customer or by an auditor it mandates who is bound by confidentiality, subject to reasonable notice.
